SECTION 1 – RESERVATION PROCESS

Upon selecting your retreat, please first read thoroughly and accept these Terms and Conditions set by Gaia Goddess Lifestyle LLC. If you have any questions pertaining to the retreat, you may contact us at info@gaiagoddesslifestyle.com. Sales of retreats are limited to 1 per transaction. Retreat attendees cannot sign terms and conditions on behalf of another attendee.

1. As a condition of registration, participants must complete, in full, a questionnaire supplied by Gaia Goddess Lifestyle LLC via email Docusign form, which includes a Confidential Statement of Psychological and Health Condition, and/or a list of currently prescribed medications.
2. Gaia Goddess Lifestyle LLC reserves the right to refuse participation to individuals on the basis of health concerns which may hinder their participation and or other participants and staff.
3. If I have answered Yes to any of the health-related questions I hereby confirm myself fit or have sought my physicians permission, to participate in the retreat activity outlined on the website. I confirm that I will notify Gaia Goddess Lifestyle LLC. of any changes in terms of my health and fitness mentioned in this questionnaire prior to participation on the retreat. I hereby state that I have read, understood and answered honestly the questions above. I understand that my participation in these activities involves the risk of injury and even the possibility of death.

SECTION 2 – TRAVEL INSURANCE

Gaia Goddess Lifestyle LLC highly recommends that each participant obtain their own personal travel insurance (foreign and domestic coverage) in case of unforeseen changes, cancellations, missing luggage, injury, or any other occurrence out of our control. Guests may wish to purchase an additional Cancel For Any Reason policy. Check with your travel insurance provider for details on this additional policy for extra coverage. As you read through our Terms of Service, please note Allianz travel Insurance at www.allianztravelinsurance.com is an option to cover unforeseen illness, travel complications, flight interruptions, and other emergencies. You can also obtain multiple quotes from Square Mouth Travel Insurance at www.squaremouth.com Gaia Goddess Lifestyle LLC has no affiliation and receives no compensation from any insurance provider and provides this information as a courtesy.

SECTION 3 – SECURE ONLINE PAYMENT

Data security is very important at Gaia Goddess Lifestyle LLC. We use Shopify Payments as our secure payment processor. We accept payment by credit or debit card, Shop Pay (Affirm) installments, Apple Pay, Meta Pay, Google Pay, and wire transfer. Gaia Goddess Lifestyle LLC accepts no reasonable payment substitutes for similar value. Purchases will appear on credit card and/or bank statements as GAIA GODDESS.

SECTION 4 – RETREAT CHANGES & CANCELLATION / REFUND POLICY

GUEST SATISFACTION. Guest satisfaction is of the utmost importance at Gaia Goddess Lifestyle LLC, our goal is to provide top-quality retreats. We accurately describe and represent the retreats and events to the best of our knowledge and ability. Sometimes unforeseen circumstances, such as severe weather or political events, can cause a change in itinerary, necessary to adapt to circumstances or events beyond our control.

ITINERARY CHANGES. Gaia Goddess Lifestyle LLC reserves the right to make changes in the itinerary, the accommodations, the transportation services, the rates, or any other arrangements, if these changes are necessary and unavoidable. We will provide reasonable substitutes for similar value. We accept no liability for a decrease in travel pleasure, if such changes occur.

NOTIFICATIONS. If changes occur during the time of preparation for a retreat or event, Gaia Goddess Lifestyle LLC will notify the participant immediately with the method of contact on file if such record exists. If the changes happen after the reservation is confirmed Gaia Goddess Lifestyle LLC will inform the guest as soon as possible.

CHANGES. At the discretion of Gaia Goddess Lifestyle LLC, if changes occur because of reasons that are beyond our control, such as war or threat of war, riots, civil strife, industrial dispute, terrorist activities, natural or man-made disasters, the participant will have the right and the possibility to transfer 100% of their retreat payment to a different date or a different retreat package with Gaia Goddess Lifestyle LLC.

PARTICIPANT CANCELLATION UNDER NORMAL CIRCUMSTANCES. If the participant must cancel their reservation at least 12 weeks before the retreat event date, 100% of the payment can be transferred to a future retreat from the original participant registration date, and the below cancellation schedule applies, if:

1. The participant has one (1) year from their original retreat reservation date to reschedule and transfer 100% of their funds. After one year, if the guest does not attend a retreat from the initial registration date, the guest forfeits their original payment. Suppose a participant chooses to transfer 100% of their funds to a future retreat within one year from the participant registration date. In that case, they are no longer eligible for a refund within the year.
2. If the guest chooses to transfer money to a different type of retreat with Gaia Goddess Lifestyle LLC please note as our retreat packages may have different prices the guest will be responsible for paying the difference in retreat cost if the rescheduled retreat costs more than the initially scheduled retreat package. If the chosen alternative retreat is less than the previously chosen one, then the difference will be refunded minus financing CC or applicable fees at their current cost rate. Approximately 3% for Credit and Debit cards, and 6% for financed payments such as Buy Now Pay Later plans.

Cancellation + Refund Schedule is as follows:

1. If the guest cancels 11 to 6 weeks before retreat start date, 50% of payment is refundable, minus financing fees.
2. If the guest cancels 5 to 3 weeks before the retreat start date, 25% of payment is refundable, minus financing fees.
3. If the guest cancels under 2 weeks before the start date of the retreat, 15% of payment is refundable, minus financing fees.
4. If the guest cancels less than 72 hours before the retreat start date, the participant will be charged the total amount of the retreat and, in this circumstance, cannot be transferred to a future retreat.
5. In the event of a documented emergency which requires cancellation, Gaia Goddess Lifestyle LLC will handle refunds on a case by case basis.

If the participant chooses to leave the retreat during the retreat dates, their retreat payment is non-refundable and will not be transferred to a future retreat.

1. For all cancellations qualifying for a partial or full refund, we will withhold, as per the original purchase method of payment, a 3% credit card fee or a 6% fee for Buy Now Pay Later Apps.
2. Gaia Goddess Lifestyle LLC is not responsible for refunding travel arrangements such as flights, personal meals, extra hotel arrangements, etc. We highly recommend each participant purchase travel insurance for each retreat to cover their costs.

GAIA GODDESS LIFESTYLE LLC CANCELLATION UNDER NORMAL CIRCUMSTANCES. If Gaia Goddess Lifestyle LLC encounters an unforeseen circumstance causing the retreat to be canceled due to an abnormally low participation rate, or an extenuating circumstance, or in the event a featured practitioner is sick and a replacement cannot be found, the participants may either transfer 100% of their funds to a future Gaia Goddess Lifestyle LLC retreat or have their money refunded in full which was paid through www.gaiagoddesslifestyle.com.

1. If a guest arrives at the retreat not of sound mind or competent physical state, on contraindicated medications and/or illicit drugs or alcohol, Gaia Goddess Lifestyle LLC has the right to refuse the guest entry to the retreat. It will be at the discretion of Gaia Goddess Lifestyle LLC on a case-by-case basis as to potential participation, reassignment, or refund. Otherwise, the guest forfeits their payment in full and cannot be given a refund.
2. During phone orientation prior to retreat or at retreat, Gaia Goddess Lifestyle LLC has the right to refuse service to anyone who we find unfit for retreat. Some circumstances we may find unfit include but are not limited to, guests who have mental illness such as schizophrenia or bipolar. A guest not physically fit for the experience may be considered a person under the influence of illicit drugs, alcohol, medications or herbs which contraindicate with cacao, kava kava, or other herbal remedies.
3. If a guest lies on their medical history form and does not clearly state all medications or herbs they are currently taking or if they do not update Gaia Goddess Lifestyle LLC with new medications the guest consumes leading up to retreat or take while at retreat, either through email or phone and the medications are a contraindicate with ayahuasca, Gaia Goddess Lifestyle LLC has the right to not refund the guest’s retreat payment or additional service payments and may be asked to leave the retreat. Gaia Goddess Lifestyle LLC is additionally not liable for the guest’s retreat experience, mental or physical health.
4. If the guest who is found unfit for the retreat before the retreat begins and has already paid for the retreat, Gaia Goddess Lifestyle LLC has the discretion to move their retreat and payment forward to a future retreat where the guest is of sound body and mind.
5. If the circumstance is one the guest cannot change such as mental illness which is not suited for self-hypnosis, or other available modalities, then Gaia Goddess Lifestyle LLC can refund the retreat payment in full.

COVID AND OTHER PANDEMIC CANCELLATIONS.

GAIA GODDESS LIFESTYLE LLC CANCELLATION. If Gaia Goddess Lifestyle LLC must cancel a retreat due to COVID-19 quarantines in the country or state where retreat is hosted, the participant may choose to transfer 100% of funds to future Gaia Goddess Lifestyle LLC retreat or the participant will receive 85% of their money refunded which was paid through www.gaiagoddesslifestyle.com. Please note that we are not able to refund the complete amount of retreat package purchased because of upfront costs necessary to run the retreat. Such as fees to hold the retreat space for selected dates, credit card fees and bank fees for refunding money.

1. Some countries Gaia Goddess Lifestyle LLC holds retreats required upon entry of a negative Rapid Antigen, RT-PCR or PCR test. We will provide the most up to date information to each participant as to what time-frame the test needs to be deemed negative. If the participant is found positive, and provides proof of positive test to Gaia Goddess Lifestyle LLC, the participant may choose to transfer 100% of funds to future Gaia Goddess Lifestyle LLC retreat or the participant will receive 85% of their money refunded which was paid through www.gaiagoddesslifestyle.com.
2. If the participant, in their home country is suddenly made to quarantine in their home country and is not permitted to travel and gives Gaia Goddess Lifestyle LLC notification of the situation, the participant may choose to transfer 100% of funds to future Gaia Goddess Lifestyle LLC retreat or the participant will receive 85% of their money refunded which was paid through www.gaiagoddesslifestyle.com.
3. If the participant falls ill for COVID-19 or other illness during the retreat, the participant may not be refunded their payment for the retreat.
4. Upon registering and paying for a retreat, the participant is taking an inherent risk to travel during a time of pandemic. If the participant does not have COVID-19 or other pandemic illness, and becomes fearful of travel, we will allow the participant to transfer 100% of their registration to a future Gaia Goddess Lifestyle LLC event. However, we will not refund money in this situation. In this situation, consider purchasing Cancel for Any Reason policy with your base travel insurance. Check with your travel insurance provider for details on this additional policy for extra coverage.

SECTION 5 – TRAVEL DOCUMENTATION

1. The participant is responsible for obtaining their own passport, visa if applicable and vaccination if necessary by the appropriate authorities prior to the retreat.
2. The participant is responsible to obtain their personal travel insurance and any additional policies they may feel necessary to travel.
3. Some countries Gaia Goddess Lifestyle LLC holds require upon entry a negative Rapid Antigen, RT-PCR or PCR test. We will provide the most up to date information to each participant as to what time-frame the test needs to be deemed negative.
4. Some countries require additional medical forms to be completed upon arrival. It is the participants due diligence to fill and bring these forms with them for entry into a foreign country. Gaia Goddess Lifestyle LLC will do our best to keep each participant up to date on what is required for entry into each country.

SECTION 6 – PHYSICAL AND MENTAL STATE & PARTICIPATION

1. All participants are required to complete the legal forms and discuss if their current physical condition is appropriate for the retreat chosen by the guest.
2. If a guest lies on their medical history form and does not clearly state all medications or herbs currently taking or if they do not update Gaia Goddess Lifestyle LLC with new medications the guest consumes leading up to retreat or take while at retreat, either through email or phone and the medications are a contraindicated, Gaia Goddess Lifestyle LLC has the right to not refund the guest’s retreat payment or additional service payments and may be asked to leave the retreat. Gaia Goddess Lifestyle LLC is additionally not liable for the guests retreat experience, mental or physical health.

1. 1. Gaia Goddess Lifestyle LLC does not allow any underage person (18 years of age, or less) to travel with us.
   2. Gaia Goddess Lifestyle LLC holds the complete right to decline any reservation for any reason. Participants and potential participants agree to accept the decisions of Gaia Goddess Lifestyle LLC staff, retreat leaders and agents while traveling with Gaia Goddess Lifestyle LLC.
   3. If a participants behavior is determined to be threatening the well-being, safety and enjoyment of the other guests, the guest may be excluded from the remainder of the retreat. If this happens, the guest is not eligible for a refund.
   4. If the participant becomes sick or injured during the retreat with Gaia Goddess Lifestyle LLC, we will help the participant to the best of our abilities to help locate treatment. The guest is responsible for treatment payment, transportation to treatment, and any additional hotel expenses.

SECTION 7 – LOCAL LAWS

1. All participants in Gaia Goddess Lifestyle LLC retreat and expeditions are required to obey the local laws and regulations of the country visiting. If the participant fails to do so, this will relieve all responsibilities that Gaia Goddess Lifestyle LLC might have under the reservation agreement.

SECTION 8 – ILLNESS DURING RETREAT

1. During the reservation process with Gaia Goddess Lifestyle LLC, the potential participant is required to present full disclosure of any medical, physical or mental disability. Along with any current medications or herbs is taking.
2. Failure to fully disclose any such conditions is breaching the contract and will result in exclusion from the retreat.
3. If during any retreat when traveling by boat the participant is required to notify Gaia Goddess Lifestyle LLC if they are not able to swim. This will allow and obligate Gaia Goddess Lifestyle LLC to take the proper safety measures to be taken to keep the participant from harm.

SECTION 9 – ACCEPTANCE OF INHERENT RISK

1. Participants who enjoy retreats organized by Gaia Goddess Lifestyle LLC acknowledge and understand and accept that exposing themselves to natural elements causes an increased risk of physical harm.
2. The participant accepts that taking part in these tours events and retreats could result in personal physical and/or mental injury, damage to personal property. The participants understand and in these retreats, these potential risks are an inherent part and the guest is voluntarily and willingly choosing to be part of these tours and retreats and their own risk.
3. The participant holds full responsibility for any accident or injury affecting their physical and/or mental health and releases Gaia Goddess Lifestyle LLC from any liability in the event of such injury.
4. Upon registration, when clicking the I accept the Terms and Conditions button the participant is releasing all responsibility from Gaia Goddess Lifestyle LLC and accepts their own full responsibility of attending the retreat, travel risk, potential personal injury, potentially exposing oneself to disease.
5. By agreeing to these Terms & Conditions set by Gaia Goddess Lifestyle LLC during registration you are agreeing to remove Gaia Goddess lifestyle LLC and its partners hotels and retreat centers from all liability.

SECTION 10 – WAIVER, RELEASE, INDEMNIFICATION & COVENANT NOT TO SUE

In consideration of participation in the Gaia Goddess Lifestyle LLC retreats, activities, events, and programs, I agree to release on behalf of myself, my heirs, representatives, executors, administrators, and assigns.

I HEREBY DO RELEASE Gaia Goddess Lifestyle LLC, the brand, its officers, directors, employees, volunteers, agents, representatives and insurers (Releasees) from any causes of action, claims, or demands of any nature whatsoever including, but in no way limited to, claims of negligence, which I, my heirs, representatives, executors, administrators and assigns may have, now or in the future, against the Gaia Goddess Lifestyle LLC brand and any related to the use of facilities/equipment or participation in the Gaia Goddess Lifestyle LLC retreats and events programs whether that participation is supervised or unsupervised, however the injury or damage occurs, including, but not limited to the negligence of Releasees.

In my consideration of my participation in activities and programs, I, the undersigned, by accepting the terms and conditions checkbox, agree to INDEMNIFY AND HOLD HARMLESS Releasees from any and all causes of action, claims, demands, losses, or costs of any nature whatsoever arising out of or in any way related to my program participation.

I hereby certify that I have full knowledge of the nature and extent of the risks inherent in any activity and program participation and that I am voluntarily assuming said risks. I understand that I will be solely responsible for any loss or damage, including personal injury, property damage, or death, and travel costs, that I sustain while participating in any activities and programs and that by signing this agreement with the check box, I HEREBY RELEASE all liability for such loss, damage, or death. I further certify that I am in good health and have no conditions or impairments which would preclude my safe participation in any activities and programs.

Gaia Goddess Lifestyle LLC and their respective parent, subsidiary, and affiliated companies, maintain no control over the personnel, equipment or operations of any air, water, bus or limousine company, catering company, transportation company, hotel, or other person or entity furnishing services, products, or accommodations as part of the retreat, because all these suppliers are independent contractors.

Gaia Goddess Lifestyle LLC and their respective parent, subsidiary, and affiliated companies, shall not be liable for any injury, damage, loss, expense, accident, delay, inconvenience, travel cost, or irregularity which may be caused or contributed to (1) by any wrongful, negligent, or unauthorized act or omission on the part of any of these suppliers or any of their agents, servants, employees, or independent contractors, (2) by any defect in or failure of any vehicle, equipment, instrumentality, service, product, or accommodation which is owned, operated, furnished, or otherwise used by any of these suppliers, (3) by any wrongful, negligent, or unauthorized act or omission on the part of any other person or entity not under the direct control of Gaia Goddess Lifestyle LLC respectively or (4) by any other cause, condition or event beyond the direct control of Gaia Goddess Lifestyle LLC respectively.

During the retreats, or events, the participant may have the opportunity to participate in various optional activities, such as yoga and other athletic activities, excursions, and side trips, Gaia Goddess Lifestyle LLC and their respective parent, subsidiary, and affiliated companies shall not be liable for any injury, damage, loss, expense, accident, delay, inconvenience, travel cost, or irregularity arising out of or relating to said participation. Liability Limitations: All travelers are subject to a variety of laws, tariffs, ticket terms and conditions, which limit or deny their right to recover for personal injuries and property damage. Provisions of this kind are found in the hotel laws of every state and country, and in most airlines, and are applicable to other travel services.

I am 18 years of age or older and I am competent to contract in my own name. I have read this document before signing below, or accepting the Terms and Conditions, and I fully understand the contents, meaning and impact of this consent, waiver, indemnity and release. This consent, waiver, indemnity and release is binding on me, my heirs, executors, administrators and assigns.

SECTION 11 – RECORDED MATERIALS WAIVER, INDEMNITY AND RELEASE

I hereby release, defend, indemnify and hold harmless Gaia Goddess Lifestyle LLC, its officers, employees or agents from and against any claims, damages or liability arising from or related to the use of the images, recordings or materials, including but not limited to claims of defamation, invasion of privacy, or rights of publicity or copyright infringement, or any misuse, distortion, blurring, alteration, optical illusion or use in composite form that may occur or be produced in taking, processing, reduction or production of the finished product, its publication or distribution.

SECTION 12 – PHOTOGRAPHS, VIDEOS, RECORDINGS AND TESTIMONIALS

I hereby authorize Gaia Goddess Lifestyle LLC and its representatives to photograph and video me, and otherwise capture my image, and to make recordings of my voice at the event or location noted below. I grant Gaia Goddess Lifestyle LLC the right to use, publish and display or permit the use, publication and display of audio- visual or digital recordings, negatives, slides, prints or other electronic images of me or testimonials created by me including all text, names, likenesses, artwork, images, trademarks or trade names at their sole discretion in any publication, multimedia production, display, advertisement or Internet publication worldwide for promoting, publicizing, marketing or explaining Gaia Goddess Lifestyle LLC and its activities and for administrative, promotional, educational or research purposes. I agree that Gaia Goddess Lifestyle LLC may use my name, likeness or biographical information, as I may supply.

I further grant to Gaia Goddess Lifestyle LLC and its representatives the right to reproduce, use, exhibit, display, broadcast and distribute and create derivative works of these images, recordings and testimonials in any media now known or later developed as well as my name for promoting, publicizing or explaining Gaia Goddess Lifestyle LLC and its activities and for administrative, educational or research purposes. I acknowledge that Gaia Goddess Lifestyle LLC owns all rights to these materials.

Throughout the site, the terms “we”. “us”and “our”refer to Gaia Goddess Lifestyle LLC and offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

Credit card information is always encrypted during transfer over networks.

You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us.

The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

SECTION 3 – ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATION

These products or services may have limited quantities and are subject to return or exchange only according to our Return Policy. We have made every effort to display as accurately as possible the colors and images of our products that appear at the store. We cannot guarantee that your computer monitor’s display of any color will be accurate.

We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at anytime without notice, at our sole discretion. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited. We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

SECTION 6 – ACCURACY OF BILLING AND ACCOUNT INFORMATION

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

SECTION 7 – OPTIONAL TOOLS

We may provide you with access to third-party tools over which we neither monitor nor have any control nor input.
